      <![CDATA[Whether putting money in offshore accounts, claiming tax exemption and write-offs, or just pulling an Al Capone-style evasion, investors are always trying to save money on federally mandated taxes. Created as a tax incentive for Americans to invest their capital in American properties, the 1031 property exchange is a completely legal way to do so.  Outlined in Section 1.1031 of the IRS Code, these exchanges follow strict guidelines in order to defer and minimize taxes, not evade them.  

1031 exchanges operate on the principle that reinvesting the profit from a property sale does not generate the funds proper to pay any tax.  When exchanging for a similarly used (“Like-Kind” property in IRS lingo), the value of the investment does not change, hence no taxable gain.  The transaction taxes are deferred until the final sale of the replacement property, thus granting the investor more money to invest in property, like a tax-free federal loan.  

Rules of the 1031 Exchange 

Since 1031 exchanges operate within federal regulations to postpone paying taxes, they must adhere to the strict guidelines outlined in the IRS code.  Only properties used for commercial purposes or intended solely as investments qualify to be exchanged with tax deferments.  Personal residences do not count and vacation homes are only acceptable if they have been rented to tenants for profit for a year or more.  If the property is of this commercial type, it may be exchanged for any other “like kind” property.  Land, house, multi-family housing structure, office, retail space, warehouse, and any other type of profitable property all may be exchanged for another.  

The value of the replacement property must be greater than or equal to the value of the relinquished property.  The same holds true for the equity and debt on the replacement property.  The sale of the relinquished property must be exchanged for a replacement property and all the proceeds from the sale of the relinquished property must be invested in the replacement. 

Investors have 45 days to complete the exchange, during which their proceeds must be held in a safe harbor so the investor (taxpayer) does not have a concrete receipt of the funds that would be eligible for taxation, thus disqualifying the exchange.  This safe harbor is referred to as a Qualified Intermediary (QI) who is responsible for moderating the transaction as a neutral party with no blood or personal relationship to the investor.  During the 45-day period, the investor must find a suitable “like-kind” replacement property in the value range mentioned in the previous paragraph.  There are no extensions, so if the deadline is not met, the investor will have to pay taxes on the relinquished property.  The number of properties investor can identify is flexible, however he must stay within at least one of three constraints; 

Investor may identify three or fewer replacement properties 
Investor may identify as many properties as he desires, but their collective value may not exceed 200% of the value of the relinquished property 
Investor may identify as many properties as he wants, but when he actually acquires a property, or properties, the value must be at least 95% of the value of all the identified properties 
The investor must choose an acceptable property and complete the purchase within 180 days of selling the relinquished property or the exchange will be compromised.

Taxable Cash Boot

Boot is another aspect of the 1031 exchange that is strictly regulated.  “Boot” refers to any property that is not like-kind that changes hands during the 1031 exchange, most often in the form of cash or mortgages.  Usually, the relinquished and replacement properties will not be completely equal in value, so one party may give cash to the other to compensate for the difference.  This is called “cash boot,” and the term includes any sales proceeds that the investor does not reinvest in the replacement property, which are both taxable. 

If the relinquished property has a mortgage on it, the investor must put a larger mortgage on the replacement property or the monetary discrepancy is called “mortgage boot,” also eligible for taxation.  Increasing the mortgage on the replacement property or putting your own money (separate from the exchange) into the property can make up the difference in purchase price, thus nullifying the mortgage boot.  All cash boot is taxable, therefore its minimization is preferential.

1031 exchanges are beneficial to the investor as they provide more start-up capital to invest in a property by saving that amount from federal taxation.  But remember, taxes are not cancelled, merely postponed until the property is ultimately sold.  Or the investor can keep the property until death when taxes no longer apply.

Preconstruction Condos are a great way to take advantage of the 1031 Tax Exchange.

Yahoo Travel has recently rated Myrtle Beach a top 10 beach destination!

Myrtle Beach is one of the fastest growing cities throughout the US. Housing is still very cheap and offers so much to do. For those of you who do not know much about Myrtle Beach, it's located along the Eastern part of South Carolina and offers a great resort destination to family travelers and known for it's 100+ golf courses.

Here is a bit of information about the location:

<strong>HISTORY:</strong>

Myrtle Beach was uninhabited until 1908 when a railroad was built between Conway and Myrtle Beach. The railroad ended in 1899 in the locale of Pine Island and was extended four miles into the future city. The Pavilion, as well as the Seaside Inn, were built in today's downtown.

By the 1930s, the city grew to include areas as far north as present-day Ocean Forest. The Ocean Forest Hotel was built about this time (which was to be demolished in 1974). The Intracoastal Waterway began construction several years later. Almost a year later, the city was incorporated as a town in 1938 and became a city in 1957. Its name was derived from the Wax myrtle shrub that grows throughout the area.

In the 1960s, northern development in what was unincorporated Horry County began to develop, with the newly formed communities of North Myrtle Beach and Briarcliffe Acres.

Myrtle Beach continued to grow, and by the 1970s, had become well associated with tourism. Parts of what is now US 17 Bypass were built later in the decade. The building boom along the Grand Strand began in the late 1970s, with many suburbs of Myrtle Beach such as Surfside Beach and North Myrtle Beach.

By the late 1980s and into the early and mid 1990s, Myrtle Beach grew into the county's 18th largest population gain. The community of Carolina Forest eventually would house 56,000 residents. This community would either be annexed into Myrtle Beach at a later date or would become its own community. Carolina Forest has become home to many non-native residents, many of whom come from the Northeast. Because of relatively low cost of living and many amenities, it has attracted many retirees, some of whom became acquainted with the area while vacationing.

<strong>Demographics</strong>

As of the censusGR2 of 2000, there were 22,759 people, 10,413 households, and 5,414 families residing in the city. It has a metropolitan population of about 217,608 which is steadily rising. The population density was 523.7/km² (1,356.3/mi²). There were 14,658 housing units at an average density of 337.3/km² (873.5/mi²). The racial makeup of the city was 81.16% White, 12.76% African American, 0.42% Native American, 1.28% Asian, 0.13% Pacific Islander, 2.37% from other races, and 1.88% from two or more races. Hispanic or Latino of any race were 4.67% of the population.

There were 10,413 households out of which 20.3% had children under the age of 18 living with them, 36.8% were married couples living together, 11.1% had a female householder with no husband present, and 48.0% were non-families. 34.1% of all households were made up of individuals and 10.4% had someone living alone who was 65 years of age or older. The average household size was 2.17 and the average family size was 2.79.

In the city the population was spread out with 18.0% under the age of 18, 11.0% from 18 to 24, 33.6% from 25 to 44, 22.5% from 45 to 64, and 15.0% who were 65 years of age or older. The median age was 37 years. For every 100 females there were 103.0 males. For every 100 females age 18 and over, there were 101.0 males.

The median income for a household in the city was $35,498, and the median income for a family was $43,900. Males had a median income of $26,039 versus $22,473 for females. The per capita income for the city was $23,214. About 7.6% of families and 12.0% of the population were below the poverty line, including 17.1% of those under age 18 and 6.6% of those age 65 or over.

<strong>Attractions</strong>
Broadway at the Beach which is located on the north side of the city is known widely for its restaurants and all kinds of entertainment venues such as Ripley's Aquarium and NASCAR Speedpark. At the heart of downtown located right off of U.S. Route 501 there is the Myrtle Beach Pavilion which is a major amusement park in the area that draws a great number of visitors and locals. In the spring of 2006 Burroughs & Chapin, the company that owns the Pavilion, announced its closure, which occurred in September 2006.

Alligator Adventure — hailed as the 'reptile capital of the world', this attraction is located in North Myrtle Beach 
Hard Rock Park — a rock 'n' roll theme park set to open April 2008, this will be the first theme park the area has seen 
Family Kingdom Amusement Park — a sea-side amusement park 
Myrtle Waves — A major South Carolina water park

House of Blues 
Dolly Parton's Dixie Stampede 
Ripley's Aquarium 
Ripley's Believe It or Not

<strong>Shopping</strong>
Coastal Grand Mall — One of the area's most recent retail malls is Coastal Grand Mall, which is located at the intersection of U.S. Highway 17 bypass and Hwy 501. At 1.5 million square feet (140,000 m²), Coastal Grand is supposedly the largest mall in South Carolina. 
Tanger Outlet Center — There are two Tanger Outlet shopping malls, one located off of Hwy 501 and another near the intersection of Hwy 17 and the Veteran's Hwy 22. 
Broadway at the Beach — Located in the center of Myrtle Beach, Broadway at the Beach opened in 1995 and is the hub of Myrtle Beach shopping. 
Barefoot Landing — Located in North Myrtle Beach, this shopping center also includes Barefoot Resorts and residential areas west of the waterway. 
Inlet Square Mall — Located near Murrells Inlet, this shopping mall has a 12 screen movie theater, and a children's play area in the food court

      I am a recent user of the Awesome site Digg.Com! The site is a great place to find blogs for any type of industry. However, there is no category for real estate! There is a Business and finance section but I think they really should add a Real Estate Section.. There are so many of us in the Real Estate industry and what a better place than Digg to find our information?

As I am becoming more familiar with the site I am still searching for a place where we may be able to suggest a category.

If you aren&apos;t using Digg.com to find the latest information on any subject the world has to offer I strongly suggest you sign up. You can even add Blog entries to your own Blog from the Digg site! How cool is that? You find something interesting and want your site&apos;s audience to know about it, just click the little Blog it button under the story and you can have it imported right into your blog.

As a user you can find excellent entries and then click the button that says &quot;Digg&quot; this will actually rate the article, if enough people rate the article you could end up on their homepage which can deliver a tremendous amount of traffic.

I am going to submit this post to digg with the hopes that more individuals in the Real Estate industry will find out about Digg and make a big enough impact so that Digg may consider adding a Real Estate Category.

I have noticed the site being more technology related and they people over there are very friendly and offer some very valuable resources. This site was a very well thought out site and has become very useful.

I was at the SES conference this past week and was actually alarmed when some of the Panel Speakers mentioned Spamming Digg! I do not think it should be used for spamming to generate traffic to your site! Hopefully Digg will remain a valuable resource to us all and we can all help fight the spam by clicking the Bury It Button! Great tool... If you think someone is just using the site to Spam you can Bury the story and they will never make it on the site.. Great to get rid of all the spammers...

Anyway, I hope this article was a little helpful and will share some insight on the Digg site and help us in the Real Estate world start using tools like this to better understand what is happening in our industry.

THE NORTH BEACH TOWERS

The facility will provide the largest outdoor water park ever built within a Myrtle Beach oceanfront resort. Substantial indoor water amenities will also be available.

All parking will be contained in a connected 600 space covered parking garage immediately adjacent to the ocean towers complex. Access to the towers is completely covered.

A mixture of one, two, three, four and five-bedroom villas comprise the twin towers, referred to as the Indigo House (180 residences), and the Jasmine House (162 residences). We refer to these oversized, spectacular properties as “Beach Houses in the Sky” and feel that they represent, in their spaciousness, a relatively untapped market niche.
